1. Acceptance of Terms
These Terms of Service (“Terms”) are entered into by and between you and BeautyLinkNetwork LLC (“BeautyLink,” “we,” “our,” or “us”).
By accessing, browsing, registering for, or otherwise using the BeautyLink platform, website, or related services (collectively, the “Platform”), you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
These Terms apply to all users of the Platform, including clients, beauty professionals, visitors, and contributors of content.
2. Description of Service
BeautyLink is an online marketplace platform that connects clients with independent beauty professionals offering beauty services, discounted appointment slots, promotional appointments, and model call opportunities.
BeautyLink facilitates:
- Discovery of beauty professionals
- Booking functionality
- Payment processing
- Communication tools between users
BeautyLink does not:
- Provide beauty services directly
- Employ beauty professionals
- Supervise appointments
- Guarantee the quality, legality, safety, or results of services performed
All beauty services are provided independently by third-party professionals.
3. Eligibility
You must be at least 18 years old to use the Platform or book services through BeautyLink.
By using the Platform, you represent and warrant that:
- You are legally capable of entering binding agreements
- All information you provide is accurate and current
- Your use of the Platform complies with applicable laws and regulations
4. User Accounts
Users may be required to create an account to access certain features of the Platform.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Restricting access to your account
- All activity conducted under your account
You agree to notify BeautyLink immediately of any unauthorized use of your account.
BeautyLink reserves the right to suspend, restrict, or terminate accounts at its sole discretion for violations of these Terms or conduct deemed harmful to the Platform or its users.
5. Bookings & Payments
All payments are processed through third-party payment processors, including Stripe.
By booking a service, clients authorize BeautyLink and its payment processor to charge the selected payment method for:
- Service charges
- Booking fees
- Processing fees
- Applicable taxes
Full payment may be required at the time of booking.
Professionals are responsible for ensuring the accuracy of pricing, availability, and service descriptions.
BeautyLink reserves the right to refuse, cancel, or limit transactions suspected of fraud, abuse, or unauthorized activity.
6. Pricing and Fees
BeautyLink charges a booking fee on each transaction, which is added to the listed service price and paid by the client.
Unless otherwise stated:
- Professionals retain 100% of their listed service price
- Booking fees are retained by BeautyLink
BeautyLink reserves the right to:
- Modify fee structures
- Introduce new fees
- Change pricing models
- Offer promotional pricing or discounts
Changes may be communicated through the Platform, email, or updated Terms. Continued use of the Platform after changes constitutes acceptance of updated pricing structures.
7. Cancellation & Refund Policy
Clients may cancel bookings free of charge up to 24 hours before the scheduled appointment time unless otherwise stated by the professional.
Cancellations within 24 hours of the appointment may be non-refundable.
Refund eligibility may depend on:
- Timing of cancellation
- Provider-specific policies
- Evidence submitted
- Fraud or abuse investigations
BeautyLink reserves the right to issue, deny, partially issue, or withhold refunds at its discretion.
Professionals who repeatedly cancel appointments, fail to appear, or engage in unreliable conduct may face account suspension or removal.
8. Independent Professionals
All beauty professionals using BeautyLink are independent contractors and independent business operators.
BeautyLink does not:
- Employ providers
- Control provider schedules
- Dictate pricing
- Supervise how services are performed
- Provide training or certification
Professionals are solely responsible for:
- Licensing and permits
- Insurance coverage
- Sanitation and safety practices
- Compliance with local laws and regulations
- Service quality and outcomes
Providers represent that they are legally authorized to perform the services they offer through the Platform.
BeautyLink does not independently verify all licenses, certifications, training, qualifications, or legal compliance of providers and does not guarantee the quality, safety, legality, or outcomes of services provided through the Platform.
Providers maintain sole responsibility for their services, business practices, client interactions, and compliance with applicable laws.
9. Model Calls & Promotional Services
Some appointments on the Platform may be designated as:
- Model calls
- Student services
- Portfolio appointments
- Promotional or discounted services
By booking these services, clients acknowledge that:
- Results may vary
- Services may involve newer or developing professionals
- Services may take longer than standard appointments
- Certain appointments may involve photography, social media content creation, or promotional usage
Clients voluntarily assume any additional risks associated with these services.
10. Assumption of Risk
Beauty services inherently involve risks including, but not limited to:
- Allergic reactions
- Skin irritation
- Hair damage
- Burns
- Infections
- Dissatisfaction with results
By using the Platform and booking services, clients voluntarily assume all risks associated with services booked through BeautyLink.
Clients are responsible for disclosing allergies, sensitivities, medical conditions, or other relevant information to providers before services are performed.
11. Reviews & User Content
Users may submit:
- Reviews
- Photos
- Videos
- Messages
- Portfolio content
- Other materials (“User Content”)
By submitting User Content, users grant BeautyLink a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and promote such content in connection with operating and marketing the Platform.
Users represent that:
- They own or have permission to use submitted content
- Submitted content does not infringe upon third-party rights
BeautyLink reserves the right to remove content that violates these Terms or is deemed inappropriate.
12. Prohibited Conduct
Users may not:
- Create fraudulent accounts
- Manipulate reviews or ratings
- Circumvent the Platform's payment systems
- Harass, threaten, or discriminate against others
- Upload unlawful, false, or misleading content
- Attempt to interfere with Platform functionality
- Use the Platform for illegal purposes
Violation of this section may result in immediate suspension or termination.
13. Limitation of Liability
BeautyLink acts solely as a marketplace facilitator.
To the maximum extent permitted by law, BeautyLink shall not be liable for:
- Service outcomes
- Injuries or allergic reactions
- Property damage
- Disputes between users
- Lost profits or indirect damages
- Provider misconduct
- Appointment cancellations or delays
BeautyLink’s total liability for any claim shall not exceed the amount of fees paid directly to BeautyLink for the transaction giving rise to the claim.
14. Indemnification
Users agree to indemnify and hold harmless BeautyLink, its owners, affiliates, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from:
- Use of the Platform
- Violation of these Terms
- Services provided or received through the Platform
- User misconduct or negligence
15. Privacy
Use of the Platform is also governed by the BeautyLink Privacy Policy.
16. Arbitration & Dispute Resolution
Any disputes arising from these Terms or use of the Platform shall be resolved through binding arbitration in the State of California, except where prohibited by law.
Users waive the right to participate in class action lawsuits or class-wide arbitration.
17. Modifications to Terms
BeautyLink reserves the right to modify these Terms at any time.
Material changes may be communicated through:
- In-app notifications
- Website postings
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
